1. Acceptance of Terms

Welcome to Navigator AI (ai.compasscoachingonline.com), a private AI platform operated by Compass Coaching LLC ("Company", "we", "us", or "our").

By accessing or using the Navigator AI platform, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not access or use the platform.

2. Platform Access and Eligibility

• Subscription Requirement: Navigator AI is a private, subscription-gated service accessible exclusively to active members of Compass Coaching training programs. It is not open to public registration.
• Account Creation: Accounts are manually provisioned by Compass Coaching administrators. You agree to maintain the confidentiality of your login credentials and are responsible for all activities that occur under your account.
• Revocation: We reserve the right to revoke access immediately upon the termination of your Compass Coaching subscription or for any violation of these Terms.

3. AI Services and Disclaimers

The platform provides access to artificial intelligence models (including models from Anthropic, OpenAI, Google, and other leading AI providers) and specialized agents for informational and productivity purposes.

AI-generated responses. Navigator AI's responses are generated by artificial intelligence, not by a human. AI can make mistakes or produce inaccurate information — you are responsible for reviewing any output before you rely on it, especially for insurance, legal, financial, or other professional decisions.

4. Prohibited Uses

You agree not to use the platform to:

• Submit Sensitive Personally Identifiable Information (SPII), including social security numbers, financial account numbers, or protected health information (HIPAA data) of your clients.
• Generate content that is fraudulent, deceptive, defamatory, or illegal.
• Attempt to reverse-engineer, probe, or exploit the platform's infrastructure or AI models.
• Share your account credentials with unauthorized third parties.

5. Intellectual Property & Content

Your Input: You retain ownership of the text and files you submit to the platform.

AI Output: Subject to the terms of the underlying AI model providers (Anthropic, Google, OpenAI, and other providers offered on the platform), you generally retain rights to the content generated by your prompts. However, Compass Coaching LLC claims no ownership over AI-generated outputs and is not liable for their use.

6. SMS and Text Messaging

Compass Coaching LLC sends SMS messages only to active, paying clients who have provided explicit verbal consent during a one-on-one onboarding call. By enrolling in Compass Coaching services and providing your mobile number during onboarding, you consent to receive SMS messages as described in our SMS Messaging Policy & Opt-In Disclosure.

• Consent: Consent is collected verbally during your onboarding call. You represent that you are the account holder for the mobile number provided and that you have agreed to receive SMS messages from Compass Coaching.
• Message types: Appointment confirmations, course and platform updates, and customer support communications.
• Frequency: Message frequency varies. Clients typically receive 1–10 messages per month depending on program activity.
• Rates: Standard message and data rates may apply.
• Mobile number privacy: Your mobile number is never sold or shared with third parties for marketing purposes. It is shared only with Twilio, our SMS delivery provider, solely to deliver messages on our behalf.
• Opt-Out: You may opt out at any time by replying STOP to any message. You will receive a final confirmation and no further messages will be sent. Opting out does not affect your program enrollment or platform access.

• Carrier Liability: Carriers are not liable for delayed or undelivered messages.

7. Subscriptions, Billing & Refunds

Membership plans are billed on a recurring monthly or annual basis and processed securely through Stripe. By subscribing, you authorize recurring charges until you cancel. You may cancel at any time; cancellation stops future renewals, and you retain access through the end of your current paid term.

3-Day Confidence Guarantee. New members who complete at least three (3) course modules and engage with the community may request a full refund within three (3) days of their initial purchase by contacting support. After this window, payments are non-refundable, though access continues through the paid term. Custom done-for-you project engagements are governed by the separate written proposal and agreement provided for that project.

AI platform usage is subject to the usage policy published on our pricing page (a generous monthly allotment across all models, with optional paid refreshes). We may adjust plans, pricing, and allotments on a going-forward basis with notice.

8. Modifications & Governing Law

We may update these Terms from time to time. Material changes will be reflected by the "Last Updated" date above, and your continued use of our services after changes take effect constitutes acceptance. These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws principles, and any disputes shall be resolved in the state or federal courts located in Kentucky.

9. Limitation of Liability

To the fullest extent permitted by law, Compass Coaching LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or in connection with your use of the Navigator AI platform or our services.
